Regulation of Real Estate Appraisers and the Home Valuation Code of Conduct (HVCC)

In the 111th Congress, H.R. 3044 would establish a moratorium on the HVCC. H.R. 3044 states that the HVCC announced on December 23, 2008, would not have any effect for eighteen months following passage of H.R. 3044. H.R. 3044 has been referred to House Financial Services and no companion bill has been introduced in the Senate as of September 5, 2009. The Mortgage Reform and Anti-Predatory Lending Act (H.R. 1728) also addresses some appraisal activities. The bill provides that borrowers be given copies of their appraisal, that it is unlawful to influence an appraiser to achieve a desired target value, and that the bank regulators jointly issue regulations concerning deceptive practices in appraisals. The bill also designates fines for violations and establishes a consumer protection mission within the ASC. H.R. 1728 also grants the ASC authority to impose interim sanctions if state certification boards are not in compliance. This report will be updated as conditions warrant.
