Small Business Set-Aside Programs: An Overview and Recent Developments in the Law


This report discusses the set-aside programs for small businesses under the Small Business Act of 1958, as amended, and the Veterans Benefits, Health Care, and Information Technology Act of 2006, as well as recent decisions by the Government Accountability Office (GAO) and U.S. Court of Federal Claims interpreting these statutes and the regulations implementing them. These set-aside programs provide numerous contracting "preferences" to eligible small businesses, including restricted competitions (i.e., set-asides), sole-source awards, and price evaluation preferences in unrestricted competitions. Members and committees of Congress pay considerable attention to the set-aside programs.
