Regulation of Real Estate Appraisers and the Homa Valuation Code of Conduct (HVCC)

In the 111th Congress, Title VI of the Mortgage Reform and Anti-Predatory Lending Act (H.R. 1728) addresses appraisal activities. The bill provides that borrowers be given copies of their appraisal, that it is unlawful to influence an appraiser to achieve a desired target value, and that the bank regulators jointly issue regulations concerning deceptive practices in appraisals. The bill also designates fines for violations and establishes a consumer protection mission within the ASC. H.R. 1728 also grants the ASC authority to impose interim sanctions if state certification boards are not in compliance. It addresses potential conflicts of interest by prohibiting appraisers from having either a direct or indirect financial interest in the property or transaction that is subject to the appraisal. This report will be updated as conditions warrant.
